New Jersey issued a
contract for a large offshore wind project in September 2008 but
has not identified a site for it. The Company chose its site
in New Jersey based on a serious controlling factor: For most
of the coastline of New Jersey, ten miles offshore places a wind
farm in the shipping lane into New York harbor. The Company's
criteria for site selection include avoiding designated shipping
lanes. The only site that meets the criteria is east of
Atlantic City where the coast bends westward. Atlantic City is
also the largest power user on the New Jersey coast.

UPDATE April 9, 2009:
FERC and MMS
agree to rule
changes that suspend the FERC preliminary permit system for OCS wave
power projects. The Company's application has been dismissed. But our existing preliminary permit
in Washington state is not affected by this decision. We will
continue our business in the other sites using the new permit
system. The Company's plans for these sites are not affected
by the change in the FERC preliminary permit system.
